The U.S. Army Corps of Engineers, Chicago District jointly with the Chicago Metro Office of the U.S Fish and Wildlife Service and U.S Environmental Protection Agency, Region 5, is hereby reissuing the agreement for applicants and consultants interested in developing sites for mitigation banking activities.  This agreement, known as the Interagency Coordination Agreement on Mitigation Banking Within the Regulatory Boundaries of the Chicago District, Corps of Engineers, (ICA) is the guiding document that outlines the regulatory requirements for the authorization, management, monitoring of any proposed wetland banks in Cook, DuPage, Kane, Lake, McHenry, and Will County in northeastern Illinois and Lake, Porter, and LaPorte County in northwestern Indiana.


The following major changes have been made to the ICA:


-All requirements of the Compensatory Mitigation for Losses of Aquatic Resources; Final Rule (2008) are now reflected in the ICA;


-The performance standards have been revised to allow for more flexibility to create different wetland types and to increase success of establishing appropriate hydrologic regimes for appropriate wetland types;


-Certified credits have been eliminated;


-Clarification has been made that modifications to the bank can be made for an increase or decrease in aquatic resource created other than what was approved in MBI;


-An alternative method for determining growing season dates has been added; and


-The credit sales form has been revised to require ledger balance after each credit transaction has been made.  



Please note that any banks permitted under the previous version of the ICA, dated June 2008 will continue under those terms.   Mitigation banks currently in process will follow the terms of the new ICA.
